Terms and Conditions for Drivers and Users of CT APP CORPORATION

In some parts of this document, you will find members referred to as drivers and vice versa, as well as users referred to as passengers and vice versa.

CT App Corporation operates a digital marketplace accessible through various channels, including mobile applications CT Drivers, CT Passenger, and CT Ride, web browsers, phone calls, among others. Through CT App Corporation's marketplace platform, you can access services facilitated by the company, streamlining your requests to independent external providers, including members of the App, for services such as transportation. This platform also offers personalized content, including features, recommendations, and product or service advertisements. Additionally, it provides support services, including payment processing and customer service. Unless expressly agreed otherwise in a written agreement with you, CT App Corporation's Services and Platform are intended solely for personal, non-commercial use. By accessing or using our platform, you agree to be legally bound by these terms and conditions.

You acknowledge that your ability to request and obtain transportation services from external providers through CT App Corporation's platform does not make the company a transportation service provider, transporter, or vehicle owner. CT App Corporation's role is to connect users with an external provider, and the use of its platform is reserved exclusively for registered users, not available to the general public.

Additionally, you agree that independent external providers, including App members, are not agents or employees of CT App Corporation in any way. Likewise, any efforts, features, processes, policies, rules, or other initiatives that CT App Corporation undertakes for safety purposes (whether required or not by applicable regulations) do not imply an employment or agency relationship with any member or external provider of CT App Corporation's platform.

1. Platform Usage:
CT App Corporation's platform is provided to facilitate the booking and payment of transportation services and to connect passengers with drivers.

2. User Responsibilities:
2.1 Users must provide accurate, true, and up-to-date information when registering on our platform, such as name, phone number, email, address, among others.
2.2 Users must behave respectfully and courteously both towards drivers and other passengers during the journey.
2.3 When requesting a ride, you or the person you requested the ride for using the ride request functionality for another person guarantee that you are at least one of the passengers; otherwise, you and other passengers release, discharge, and forever hold harmless CT APP CORPORATION and the driver from any and all actions, causes of action, claims or demands for damages, costs, loss of use, loss of services, expenses, compensation, consequential damage or anything else arising out of, or in any way related to, any and all personal injuries known and unknown, pain and suffering, and/or death, as a result of an incident or accident during the ride.
2.4 Services cannot be used by individuals under 18 years of age.
2.5 You may not authorize third parties to use your account or allow individuals under 18 years of age to request or receive transportation services unless accompanied by you.
2.6 You may not access or use the Services for illegal purposes, such as transporting illegal or hazardous materials.
2.7 When using the Services or physical facilities, you may not cause annoyance, inconvenience, disruption, or damage to property, whether against the External Provider, member, administrative, executive, managerial, or facilities.

3. Reservations and Payments:
3.1 Users can book rides through our application and must pay the cost of the ride according to the established rates and the selected payment method.
3.2 Drivers will receive the corresponding payment for the services provided through our platform.

4. Cancellations and No arrivals:
4.1 Users can cancel a reservation within the specified timeframe without additional charge.
4.2 Users who do not show up for a booked ride or cancel outside the established cancellation period may be subject to additional charges.
4.3 Drivers who cancel a ride without a valid reason are subject to measures that may include account suspension.

5. Ratings and Reviews:
5.1 Users and drivers have the option to rate and leave comments about the travel experience.
5.2 Ratings must be accurate based on the travel experience, and comments must be respectful.
5.3 Low ratings or comments that may affect safety are subject to investigations by CT App Corporation. The driver or user who provided such rating or comment must be willing to cooperate with the investigation.

6. Privacy and Security:
6.1 CT App Corporation is committed to protecting the privacy and security of user and driver data, as described in our privacy policy.

7. Modifications and Updates:
7.1 CT App Corporation reserves the right to modify these terms and conditions at any time. Modifications will become effective upon being published on our platform.

8. Service Termination:
8.1 CT App Corporation reserves the right to terminate access to the platform in case of breach of these terms and conditions by users or drivers.

9. Arbitration Procedure and Dispute Resolution Agreement:
By accepting the Terms, you agree that, before initiating any arbitration process, you must attempt to resolve any claim you may have against CT App Corporation through a direct conciliation process with the company. This process is governed by this Arbitration Agreement and is designed to resolve disputes on an individual basis, rather than through collective, joint, coordinated, group, mass, or representative lawsuits.

This Arbitration Agreement prevents you from initiating collective, joint, coordinated, group, mass, or representative lawsuits against CT App Corporation. Additionally, it prevents you from receiving or participating in any compensation as part of a collective, joint, coordinated, group, mass, or representative lawsuit, current or future, against CT App Corporation filed by any other person.

License and Usage Restrictions

License:
CT App Corporation grants you a limited, non-exclusive, revocable, non-transferable license to use and access the Applications on your personal device solely in connection with your use of the Services. Additionally, you may use and access any related content, information, and materials available through the platform, but solely for your personal, non-commercial use. CT App Corporation reserves the right to grant this license and may revoke it at any time.

Restrictions:
You agree not to perform the following actions:
a. Remove copyright notices, trademarks, or ownership from any part of the Services.
b. Reproduce, modify, create derivative works, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, retransmit, broadcast, or otherwise exploit the Services, unless expressly permitted by CT App Corporation.
c. Decompile, reverse engineer, or disassemble the Services, except as permitted by applicable law.
d. Link, mirror, or frame any part of the Services.
e. Create or launch programs or scripts to overload or improperly affect the operation of the Services.
f. Attempt to access the Services without authorization or alter any aspect of them or their related systems or networks.
g. You agree not to use CT App Corporation's trademarks, service marks, or trade dress, or any similar name, mark, or trade dress of CT App Corporation, except for the incidental use of the Services, without the express written permission of CT App Corporation.

Third-Party Content:
Within CT App Corporation's platform, you may encounter third-party content, including advertisements. By clicking on these links, you agree to be bound by the Terms and Conditions and privacy policy of the third-party website. CT App Corporation will not notify you that you have left the Services or that you will be subject to the Terms and Conditions and privacy policy of third parties. All links to third-party websites and advertisements are used at your own risk, as they are not controlled by CT App Corporation.

Communications via Text Messages, Calls, and Emails:
You agree that CT App Corporation, its representatives, members, executives, and managers may communicate with you by phone, text messages (including through automated dialing systems, OTP codes, or prerecorded voice messages), and email, using the phone numbers and emails provided by you or on your behalf, linked to a CT App Corporation account. These communications may include marketing messages. You understand that it is not necessary to give this consent as a condition to acquire the service. Additionally, you understand that at any time, you can choose not to receive advertising content; however, you cannot opt out of receiving content used for data verification purposes, affecting security, or interfering with any ongoing investigation processed by CT App Corporation.

Terms and Conditions for Active Drivers

By becoming an active driver on our platform, you agree to comply with the following policies and regulations established by CT App Corporation:

Required Documentation: You must keep all documentation required by both CT App Corporation and local laws and regulations valid.
Trip Acceptance Rate: Your trip acceptance rate must not be less than 80%. Accepting most trip requests is essential to maintaining a reliable and satisfactory service for our platform users.
Minimum Rating: Your driver rating must not be lower than 3.5. Ratings provided by users are important indicators of service quality and customer satisfaction.
Compliance with Quality Policies: You must comply with all quality policies established by CT App Corporation. This includes, but is not limited to: providing friendly service, driving safely, keeping the vehicle clean, and others.
Active Investigations: You must not be under any active investigation following a report on the platform. Any ongoing investigation related to your conduct as a driver can result in disciplinary measures, including account suspension or termination.

By accepting these terms and conditions, you acknowledge that you are committed to complying with these policies and regulations as an active driver on our platform. Violation of any of these conditions may result in the suspension or termination of your account as an active driver of CT App Corporation.

Before activating your account:

Road Test in Person: After completing all requirements in the application for your driver and vehicle profile, you are required to attend and PASS an in-person Road Test. This examination is conducted to assess your proficiency and control of the application. A fee of $50.00 will be charged for each Road Test attempt, which is non-refundable. However, these charges are credited to your wallet upon PASSING THE ROAD TEST to activate your account. Please note that no amount credited to the wallet is refundable under any circumstances.By accepting this procedure, you understand and agree to the terms set forth by CT App Corporation for the Road Test as part of the account activation process as a driver on our platform.

CT App Corporation Membership Terms and Conditions

By making any payment associated with any of the membership types offered by CT App Corporation, you confirm and agree that you are in compliance with the established terms and conditions, even if you have not signed any physical or digital documents. Your payment is considered your full consent and acceptance of all the clauses, policies, and requirements specified in the membership terms and conditions. We urge you to carefully review these terms and conditions before making any payment to fully understand your rights and responsibilities as a member of our platform. By making a payment, you acknowledge and agree that you are legally bound by these terms and conditions and commit to complying with all the provisions outlined.

Modifications and Updates:
The terms and conditions outlined here are subject to changes at the discretion of CT App Corporation and may be modified at any time without prior notice. Any modifications will become effective immediately upon their publication on our platform. It is your responsibility to regularly review the terms and conditions to stay informed of any updates. By continuing to use our services after any modification, you accept and commit to complying with the modified terms and conditions. We recommend reviewing this section regularly to stay informed about changes that may affect your membership and your relationship with CT App Corporation.

Terms and Conditions for Commission-Based Affiliate Membership (Indefinite Duration)

Trip Commission: Affiliated drivers under this membership will pay a predetermined commission for each trip they make through our platform. The commission will be automatically deducted from your earnings.

Initial Wallet Balance: Drivers affiliating through commission must load the wallet with an initial balance of $100.00, which is non-refundable under any circumstances. These funds are immediately utilized by CT App Corporation to cover registration, administrative, and operational expenses related to your affiliation with our platform.

Membership Cancellation: CT App Corporation reserves the right to cancel the membership at any time if these terms and conditions are violated.

Terms and Conditions for 6-Month Membership (No Commission)

Membership Duration: This membership is valid for a period of 6 months from the date of purchase.

One-Time Payment: The price of this membership is $750.00, payable as a one-time fee upon affiliation.

Trip Commission: Affiliated drivers are exempt from paying commission for each trip.

Active Driver Requirement: As a holder of a CT App Corporation membership, you must be an active driver on our platform, adhering to the policies and regulations set by CT App Corporation and local authorities.

Periodic Verification: CT App Corporation reserves the right to periodically verify your status as an active driver. If at any time it is determined that you no longer meet this requirement, your membership may be suspended or canceled without prior notice.

Consequences of Inactivity: If you cease to be an active driver, you will lose the benefits associated with your membership.

Advertising Obligations: Affiliated drivers must continuously replicate the company's advertising on their social media platforms. They must have at least 1 of the following social media accounts active: Facebook, Instagram, and TikTok.
The advertising should be reproduced on their social media as follows:

• Facebook: Through stories and by sharing the company's post on your profile.
• Instagram: By reposting through stories and regular posts.
• TikTok: In the form of a repost.

Transferability: This membership is non-transferable and can only be used by the account holder.

Automatic Renewal: This membership will not renew automatically at the end of the 6-month period. You must manually renew if you wish to continue with the benefits.

Monthly Administration Fee: Commission-free memberships are subject to a monthly administration fee, which will be applied from the first month of affiliation. This administration fee aims to cover the operational and maintenance costs of the platform.

Modification of the Administration Fee: CT App Corporation reserves the right to modify the monthly administration fee at any time, without prior notice. Affiliated drivers will be notified by email about any changes in the administration fee before it takes effect.

Acceptance of Modifications: By keeping your membership active after any modification in the monthly administration fee, you accept the newly established amount. If you disagree with the new administration fee, you have the option to cancel your membership without incurring penalties; however, payments made up to the cancellation date are non-refundable.

No Refund: All payments made for membership and administration are non-refundable under any circumstances. Regardless of the reasons, once a payment has been made, it will not be refunded.

Immediate Use of Funds: You understand and accept that the money paid for the membership is immediately used by CT App Corporation to cover registration, administrative, and operational expenses related to your affiliation with our platform.

Exceptions: There are no exceptions to this no-refund policy. Even in the case of early cancellation of your membership or its suspension due to violation of our terms and conditions, no refunds will be issued for the amount paid.

Cancellation of Membership: CT App Corporation reserves the right to cancel the membership in case of violation of the terms and conditions.

Terms and Conditions for 12-Month Membership (Commission-Free)

Membership Duration: This membership is valid for a period of 12 months from the date of purchase and/or acquisition.

One-Time Payment: The price of this membership is $1,200.00. It is paid as a one-time fee at the time of affiliation.

Trip Commission: Affiliated drivers are exempt from paying commission for each trip.

Active Driver Requirement: As the holder of a CT App Corporation membership, it is mandatory for you to be an active driver on our platform. This means you must comply with the policies and regulations established by CT App Corporation and local authorities.

Periodic Verification: CT App Corporation reserves the right to regularly verify your status as an active driver. If at any time it is determined that you no longer meet this requirement, your membership could be suspended or canceled without prior notice.
Consequences of Inactivity: If you cease to be an active driver, you will lose the benefits associated with your membership.

Advertising Obligations: This membership is completely exempt from advertising obligations.

Transferability: This membership is not transferable and can only be used by the account holder.

Automatic Renewal: This membership will not be renewed automatically at the end of the 12-month period. You must renew manually if you wish to continue with the benefits.

Monthly Administration Fee: Commission-free memberships are subject to a monthly administration fee, which will be applied from the first month of affiliation. This administration fee aims to cover the operational and maintenance costs of the platform.

Modification of the Administration Fee: CT App Corporation reserves the right to modify the monthly administration fee at any time, without prior notice. Affiliated drivers will be notified by email about any changes in the administration fee before it takes effect.

If you disagree with the new administration fee, you have the option to cancel your membership without incurring penalties; however, payments made up to the cancellation date are non-refundable.

No Refund: All payments made for membership and administration are non-refundable under any circumstances. Regardless of the reasons, once a payment has been made, it will not be refunded.

Immediate Use of Funds: You understand and accept that the money paid for the membership is immediately used by CT App Corporation to cover registration, administrative, and operational expenses related to your affiliation with our platform.

Cancellation of Membership: CT App Corporation reserves the right to cancel the membership in case of violation of the terms and conditions.

Terms and Conditions for Permanent Membership (Commission-Free):

Membership Duration: This membership is valid permanently, meaning it has no expiration date.

One-Time Payment: The price of this membership is $999.00, payable as a one-time payment at the time of affiliation.

Trip Commission: Permanent members or their designated drivers are exempt from paying commission for each trip.

Advertising Obligations: Permanent members and their designated drivers, if applicable, must continuously replicate the company's advertising on their social media platforms. These must include active accounts on WhatsApp, Facebook, Instagram, and TikTok.
The advertising should be reproduced on their social media as follows:

• WhatsApp: Through stories and broadcast groups with their contacts.
• Facebook: Through stories and sharing the company's post on the wall.
• Instagram: Reposting through stories and regular posts.
• TikTok: In the form of reposts.

Active Driver Requirement: As a permanent member of CT App Corporation, it is mandatory that you are an active driver on our platform or designate an active driver. This means you must comply with the policies and regulations established by CT App Corporation and local authorities.

Designation of Active Driver: If at any time the holder of the Permanent Membership ceases to be an active driver for CT App Corporation, either by their own decision or because CT App Corporation has notified them of non-compliance with the requirements to continue as an active driver, they must designate another person who meets the requirements to be an active driver on our platform. This designation must be communicated in writing to CT App Corporation within a maximum period of 30 days from the date the member ceases to be an active driver. If this notification is not received within the specified period, CT App Corporation will consider the membership canceled.

Transferability: This membership is transferable under the condition of sale for a value equal to or higher than the original purchase price. Additionally, it must have prior approval from the company, considering the eligibility of the new member. A further payment of 10% of the sale value must be made to CT App Corporation for this transfer to be valid.

Beneficiary in Case of Death: Upon purchasing the membership, you can choose a beneficiary in case of your demise. This beneficiary must also adhere to the terms and conditions established by CT App Corporation. This clause becomes void if, at any point, the member transferred the membership during their lifetime.

Monthly Administration Fee: Commission-free memberships are subject to a monthly administration fee, which will be applied from the first month of affiliation. This administration fee aims to cover the operational and maintenance costs of the platform.

If you disagree with the new administration fee, you have the option to cancel your membership without incurring penalties. However, payments made up to the cancellation date are non-refundable.

Meeting Attendance: The holder of the Permanent Membership agrees to participate in scheduled meetings, whether virtual or in-person, offering training on marketing strategies and providing reports on the corporation's functioning. Attendance at these meetings is mandatory. An unjustified absence from these meetings may be considered, at CT App Corporation's discretion, as grounds for the immediate cancellation of the permanent membership.

Annual Participation Bonus: At the discretion of CT App Corporation and at the end of each fiscal year, a bonus will be granted to permanent members based on the corporation's net earnings, provided they are in good standing with all their obligations and have not incurred in 3 or more admonitions by CT App Corporation. To be eligible for this annual bonus, permanent members must be up-to-date on all payments and comply with all policies and regulations set forth by CT App Corporation throughout the respective fiscal year. The amount and eligibility for this bonus will be determined at CT App Corporation's discretion. This bonus serves as a token of recognition for their continuous contribution, ongoing fulfillment of their obligations upon purchasing this membership, and commitment to service excellence as permanent members of our platform.

Non-Refund Policy: All payments made for membership and administration are non-refundable under any circumstances. Regardless of the reasons, once a payment has been made, it will not be refunded.

Immediate Use of Funds: You understand and accept that the money paid for the membership is used immediately by CT App Corporation to cover registration, administrative, and operational costs related to your affiliation with our platform.

No Exceptions: There are no exceptions to this non-refund policy. Even in the case of early cancellation of your membership or its suspension due to a violation of our terms and conditions, no refunds will be made for the amount paid.

Membership Cancellation: CT App Corporation reserves the right to cancel the membership in case of violation of the terms and conditions.
